BOARD OF SELECTMEN
August 21, 2007 The regular meeting of the Board of Selectmen took place on Tuesday, August 21st, 2007 at the Evans Memorial Building. Present were: Don Philbrick, Rick Young and Lee Stack. The meeting was called to order at 7:00 p.m. The Selectmen reviewed checks and signed the accounts payable manifest for $16,472.16 for 25 items. The minutes for the meeting of August 14th were accepted as read. An issue over a tax bill for Marianne Omara has been referred to the assessor. Rick Young said he has emailed Matt Lowe with respect to setting up a meeting with the Bridge Committee. A suggested date was September 5th. Rick Young said he would be looking at the checklist for potential Planning Board members. Lee Stack updated the Selectmen on an access issue at the end of Lary Rd. The legal issue is one of access to parcels of land on roads discontinued before 1941 where no provisions were made for an easement. Cheryl Lieber filed a building permit application for a sign for her law office on Rte 153 (Tax map R4, lot 19). It was reviewed, approved and signed by the Board of Selectmen (Building permit #2716). The fee of $5 was paid by check. Heather McKendry discussed her plans for building a dwelling on her property. They included using the existing structure as a temporary dwelling. The Selectmen said this would require approval from the Zoning Board of Adjustment and she was provided with an application form and explanatory materials. The Selectmen emphasized the need for an inground septic system in compliance with State statutes even for a temporary dwelling. Signature item was a letter to the Moultonborough Board of Selectmen supporting their recommendation that title deeds at the Carroll County Register of Deeds be available on line provided personal information was not included. The Selectmen noted that title deeds the Town is familiar with do not contain such items as social security numbers. Ann Alton, the Carroll County Register of Deeds, had submitted materials arguing against the Moultonborough proposal. The Fish & Game Department had replied to the Selectmen’s letter and said they will not hold a Public Hearing on their proposals for accessing Purity Lake. They insisted on having only informational meetings. The Selectmen reviewed correspondence from 1999 clearly stating the Town’s strenuous opposition to the State’s plan to purchase and develop an access to Purity Lake. David Pandora had submitted an inspection report recommending that an occupancy permit be issued for the Robert Blaney property on Towle Hill Rd (Tax map R 7, lot 6). The NH Supreme Court has reversed a Rockingham County Superior decision which had found the state wide property tax was discriminatory and unconstitutional. The Coalition Communities noted the decision was based on procedure and not on the constitutionality of the tax. FEMA has made a payment of $180,366.16 for the April storm.
