BOARD OF SELECTMEN
July 24, 2007 The regular meeting of the Board of Selectmen took place on Tuesday, July 24th, 2007 at the Evans Memorial Building. Present were: Don Philbrick, Rick Young and Lee Stack. The meeting was called to order at 7:00 p.m. The Selectmen reviewed checks and signed the accounts payable manifest for $17,099.03 for 22 items. Kenneth McKenzie said he will accept the appointment to the Conservation Commission and was subsequently sworn in by the Town Clerk. He also discussed the status of his outstanding lawsuit against the Town on the alleged violation of his constitutional rights by the Zoning Board of Adjustment. He indicated that, if necessary, he would pursue it to the Supreme Court level and that it would cost the Town continuing legal fees. He said he had spent a lot of money and time on the zoning ordinance issue. He urged a settlement. The minutes for the meeting of July 17th were accepted as amended. Susan Brooks signed checks. Jim Brooks presented to the Town a painting of the Little White Church by Chuck Selmi. Don Philbrick noted that the Department of Transportation had started paving Rte 153 and were up to the Freedom line. Rick Young said he had spoken with Elwyn Thurston about the mitigation for the Bush Rd. The plan agreed to with FEMA was to put in another 24" culvert alongside the existing one on Stewart Rd. Rick Young said he would have preferred an engineering study to determine the right solution once and for all. Otherwise, the road is just going to wash out again Elwyn Thurston has been asked to order a "Dead End" sign for the Roberts Rd. He will also pop the old flag pole when the new one is ready for installation. Rick Young said he had spoken with Charlie Gibbs of the New Hampshire Department of Transportation about the posts around the beach. The State can supply them but staffing problems precludes them being installed by the Department of Transportation at this time. Rick Young said he had spoken with the American Legion about flags for veterans in the cemeteries. They will take care of it. The fire pond was discussed. Jason Call has been contacted about whether it will affect the property value of the Heath property. An agreement needs to be signed with the Heaths before proceeding. Rick Young will get an agreement form from David Weathers. The minutes from the Annual Meeting discussion on the fire pond were reviewed. The Selectmen have discretion on whether to go out for bids. Randy Cooper discussed the culvert at the end of his driveway. He was concerned it would wash out again. He also said the Zoning Board of Adjustment will be meeting on August 6th and will be reviewing revisions to the ZBA Rules of Procedure. Nancy Burns applied for two fire permits from Rick Young for each of her properties. She also inquired about property that she thought belonged to the Town but turned out to belong to Jonathon Simonds. Lee Stack inquired about Stewart Rd. Rick Young said that Elwyn Thurston had contacted Pike Industries and they will be providing a cost estimate for paving. Lee Stack reviewed the Planning Board meeting. He said there had been a discussion about broadband access and doing a survey of who wants it and who would pay for it. The Board had also discussed a groundwater protection ordinance to deter water bottling plants. Lee Stack wondered whether putting in the new bridges on the Willis Bean Rd would open it up to development. Rick Young said the bridges were to get the traffic out of the brook. Much of the land in that area is owned by the Town. Lee Stack discussed his correspondence with the Eaton Village Preservation Society on a number of issues and recent correspondence on the beach. The Selectmen took exception to the Society’s contention that the Selectmen did not share their concerns over the beach. They noted that any major improvements to the beach needed an appropriation at Town Meeting and that was not done this year. Correspondence was received from the North Country Council concerning a survey they are doing of their services. Analysis of water samples taken by the Department of Environmental Services around the beach area indicated it was safe for swimming. The highest count recorded was 22 counts per 100 ml while the cut off level is 88. Mark Griffin and Suzanne Raiche were in attendance.
