BOARD OF SELECTMEN

May 8, 2007

The regular meeting of the Board of Selectmen took place on Tuesday, May 8th, 2007 at the Evans Memorial Building. Present were: Don Philbrick, Rick Young and Lee Stack. The meeting was called to order at 7:00 p.m.

Jane Gray filed a building permit application for an 8½' x 18' enclosed addition to an existing porch for property located on Glines Hill Rd (Tax map R3, lot 3). The Board of Selectmen reviewed, approved and signed the permit (Building permit #2704). The fee of $15.30 was paid by check.

Brian Bailey discussed the lack of broad band access on Stewart Rd. Rick Young provided background information on discussions with the cable company over many years and the attempts made to expand the system. The issue is density, i.e. the number of houses per mile and it is unlikely that Eaton will be able to meet the minimum requirements. Lee Stack recounted his recent discussions with Time Warner on this issue and that the chances of lowering the density are bleak.

Doug Prescott inquired on Town requirements for putting in a well. The Selectmen said that was up to the State. They noted the regulatory 75' separation between well and septic and that the State will require a waiver of liability if the well is within the 75' of a boundary line. Doug Prescott also inquired about FEMA funds for restoring Cove Camp Rd, (a private road) damaged during the last storm. Rick Young noted that 9 out of 10 counties in New Hampshire qualified for public (municipal) assistance but Carroll County was not one of the five counties that qualified for private assistance. However, that may change depending on how much the Agency hears from individuals. It was suggested to Doug Prescott that he contact FEMA. Lee Stack provided the information on who to contact.

The minutes for the meeting of May 1st were accepted as amended.

Rick Young said he had spoken with Cliff Cabral and he will ensure the cemeteries are taken care of in time for Memorial Day.

Rick Young met up with Elwyn Thurston on Potter Rd. All the roads in Town are passable but Coleman has run out of 3/4" gravel and it may be some time before the roads are finished off.

Ryan Bushnell has started mowing the blueberry fields, Foss Mountain Rd is rough but passable. There is still snow up there.

Rick Young and Lee Stack attended the FEMA meeting in Ossipee on Monday evening and filed an application for FEMA funds. FEMA is expected to fund up to 75% of the costs incurred for storm damage. Costs for repairs have to be submitted within 60 days of the storm with all the information to be submitted electronically. Hazard mitigation funds may be available for Stewart Rd and for Bush Rd. Rick Young noted that there had been much more attention to historical, archeological and environmental concerns than on previous FEMA occasions. It is not clear how much the State will pick up. Normally, it is 12½% but the State has already been hard hit with two major disasters in the last couple of years. There was discussion about the legislative actions on funding previous disasters. The Selectmen agreed to send a letter to the local State representatives (Representative Robert Bridgham and Senator Joseph Kenny) urging them to provide equal treatment for municipalities hit by the recent storm.

Lee Stack asked about the status of Glines Hill. Don Philbrick said that was closed on the Madison side. It was not known when it would be reopened.

Signature items were letters to Kenneth McKenzie on access to records, Jesse Lyman for renewal of the furnace maintenance contract, and to Alexander McKenzie, Paul Paradis, Diane Parker and William Voss on their abatement requests.

The Department of Health and Human Services had sent a brochure on "Seasonal, Avian and Pandemic Flu" .

The Coalition Communities were seeking support for a constitutional amendment to allow targeted aid for education. Otherwise, they said that Eaton would be forced to raise an additional $120,626 in property taxes.

The new update of the Current Use booklet is now available.

The law firm of Gardner, Fulton and Waugh is increasing their hourly rates.

The Local Government Center has updated "Knowing the Territory - A Survey of Municipal Law for New Hampshire Local Officials".

The New Hampshire Board of Tax and Land Appeals is holding a Public Hearing on changes to its organizational and procedural rules on May 31st in Concord.

A recent New Hampshire Supreme Court decision on seasonal dwellings was reviewed.

The Selectmen inquired of Mark Griffin whether training costs were complete. He said he was scheduled go to Concord later this month. He consulted with Colleen McCormack-Lane as necessary. The Selectmen noted the budget will be under pressure this year because of an expected over run for the Highway Department because of the storm.

Mark Griffin and Suzanne Raiche were in attendance.
