BOARD OF SELECTMEN

October 9, 2007

The regular meeting of the Board of Selectmen took place on Tuesday, October 9th, 2007 at the Evans Memorial Building. Present were: Don Philbrick, Rick Young and Lee Stack. The meeting was called to order at 7:00 p.m.

The minutes for the meeting of October 2nd were accepted as read.

Don Philbrick reviewed the information regarding over expenditures and an emergency appropriation. Copies of RSA 32:11 were distributed. Subsequently, the Selectmen approved and signed a letter to the Department of Revenue Administration requesting that some of the fund balance be used to offset the costs incurred in repairing roads damaged by the April flood. The amount requested was $35,349.

Rick Young said there was a brush fire on Friday night down on Potter Rd. It had been put out quickly. A bill will be forth coming from Center Conway.

The Conservation Commission met last night. Rick Young said they discussed the installation of the new bridges for the Willis Bean Rd. The headers have been poured and the bridges may be installed next week or soon. The Conservation Commission had also reviewed the Dredge and Fill Permit application for Phil Steele and Camp Waukeela. They were not excited about more sand being put down on the beach because it always ends up in the Lake but agreed to send in the application without comment. They will send a separate letter of concern to Phil Steele. One suggestion discussed at the meeting was to install a culvert across the road essentially bypassing the beach sand.

Lee Stack said he eventually did hear from FairPoint Communications about DSL access. It was suggested sending out a letter with the tax bill to determine interest . It was noted that Verizon could just as easily do it since they already had all the information on residents, including street addresses.

Lee Stack said that January 2nd, 2008 is the date of decision on whether the Public Utilities Commission approves the Verizon/Fairpoint Communications agreement.

Suzanne Raiche and Mark Griffin met with the Selectmen to discuss the Vital Records Report. The Selectmen were fully supportive of those issues, such as the purchase of additional fire proof filing cabinets, that would be funded by a grant. They were a trifle more skeptical of some of the other recommendations, such as heat and humidity controls, that would involve a town expenditure. There was also some concern that the report focused exclusively on printed records without considering the different forms and formats that contemporary records can take.

Mark Griffin met with the Selectmen to discuss a wash out problem on his property resulting from the April storm. The Selectmen noted the April storm had been a 100 year storm event and most of the roads and culverts in Town had not been able to handle the run off. Mark Griffin was requesting the Town contribute to restoring his back yard. He said the culvert of Youngs Rd was known to be failing for some time. The Selectmen noted that the Town had appropriated funds for work on Youngs Rd at this year’s Town Meeting but without any mention of the culvert in question. They also noted that they had never received any written or verbal communication regarding this particular culvert. Under RSA 231:92 a municipality shall not be held liable for damages for personal injury or property damage unless the Town had received written notice of the problem. There was agreement among all present that, to their knowledge, the Town had never received any such written communication about a problem with the culvert on Youngs Rd. The Selectmen made several suggestions and agreed to a site visit later in the week.

UNH announced workshops around the State on timber harvesting laws.

Mark Griffin and Suzanne Raiche were in attendance.
