BOARD OF SELECTMEN

SEPTEMBER 2, 2008

The regular meeting of the Board of Selectmen took place on Tuesday, September 2nd, 2008 at the Evans Memorial Building. Present were Rick Young, Don Philbrick and Aaron Blake. The meeting was called to order at 7 p.m.

The Supervisors of the Checklist were in session from 7 to 7:30 p.m.

The Selectmen reviewed checks and signed the accounts payable manifest for $61,428.87 for 17 items.

Nancy and Bob Malvesta filed a building permit application for a greenhouse on their property on Lary Rd (Tax map R6, lot 24). It was reviewed, approved and signed by the Board of Selectmen (Building permit #2820). The fee of $5 was paid in cash.

The minutes for the meeting of August 26th were approved as distributed.

The Selectmen said they had all site visited the Cooper culvert issue on Stewart Rd. It was noted that the Cooper culvert was installed by Maurice Frechette when construction took place and is not the Town’s responsibility. The Selectmen said the water could not get down to the Town’s culvert and the ditch needs to be dug deeper to enable it to do so. It was noted that the Town’s culvert on Stewart Rd was clear and appeared to be working fine. A letter with the above details will be sent to the Coopers.

Rick Young noted a timber cut taking place on the Arnold property without a current ‘Intent to Cut’ permit. A letter will be sent to the owner.

Don Philbrick said that Nancy Burns and John Hartman had agreed to be the ballot checkers for the Primary Elections on September 9th. The Selectmen agreed to hold their meeting from 11 a.m. to 1 p.m. on that day.

Susan Hay met with the Selectmen and discussed the process for a boundary line adjustment the Hay’s are negotiating with Pauline Thoms. She was given an application form and will return to Town Hall on September 3rd to get abutter addresses and other details.

Carol Mayhofer signed checks.

The balance sheet for the MS-5 was reviewed and will be signed next week.

The Local Government Center’s Health Trust has initiated a new program on cost savings for prescription drugs.

The Department of Environmental Services has issued a permit for operation of a septic system for William Perk on Brownfield Rd (Tax R11, lot 21).

The 911 program has issued street numbers for William Perk on the Brownfield Rd (932) and Eugene Long on Hatch Hill (3).

The latest testing of the beach area on Crystal Lake by the Department of Environmental Services yielded no counts higher than 4 cts per 100 ml for E. Coli. This is well within the 88 cts/100 ml limit for safe swimming.

Details of the Fall Planning Conference at Loon Mountain on October 25th were received.

Also distributed was an article on practicing consistency in applying land use regulations.

BOARD OF SELECTMEN

September 9, 2008

The regular meeting of the Board of Selectmen took place on Tuesday, September 19th, 2008 at the Evans Memorial Building. Present were Rick Young, Don Philbrick and Aaron Blake. The meeting was called to order at 11:05 a.m. It was Primary Election Day.

The minutes for the meeting of September 2nd were approved as amended.

Rick Young distributed a draft of a specification for resetting the granite slabs in the Eaton Village Cemetery. A notice was drafted and approved for posting in the newspaper seeking sealed bids for the work. Deadline for submissions was set for September 30th with a completion date of October 31st.

Rick Young said he had spoken with Stewart Heath about the new Blue subdivision road off Crystal Lake Rd. Stewart Heath has completed the construction and asked the Selectmen to inspect it. Rick Young said he had visited the road and was not ready to sign off on it yet. The ditch was not in place in some areas, and there was debris cleared from the edge of the road. He also noted there had been no on site inspections during construction. The other Selectmen will visit the site this week.

The Eaton School Board had requested use of the Town Hall on Thursday September 18th at 6:30 p.m. for the annual visit from SAU 9.

Signature items were letters to Elizabeth Edge inquiring when stairs had been added to access the lake front deck since the assessment card did not show their existence and to David Arnold noting that Town did not have a current ‘Intent to Cut’ permit on file for a logging operation that had been taking place over the past year.

Rick Young said the Conservation Commission had met the previous evening. No schedule has been set for mowing of the top of Foss Mt. Stewart Heath has still to improve the access.

The Conservation Commission is seeking volunteers to do the wetlands delineation but there may be difficulty in getting them because of the time commitment.

Details for a contract for resetting the granite stones in the Eaton Cemetery were discussed.

Jane Gray met with the Selectmen and confirmed the details of the September 18th meeting. She updated the Selectmen on School issues.

There had been an inquiry about the triangle of land in front of the Snowville Cemetery. Apparently it belongs to the Town.

The Department of Revenue Administration approved the extension for the MS-1 to October.

CASA (Court Appointed Special Advocates for Children) were requesting a special article be placed on the Town warrant in 2009 for $500. The Selectmen noted that such warrant articles require a petition with ten signatures.

Signature item was a letter to the Cooper’s regarding the problem with their driveway drainage.

It was a slow Election Day.

BOARD OF SELECTMEN

September 16, 2008

The regular meeting of the Board of Selectmen took place on Tuesday, September 16th, 2008 at the Evans Memorial Building. Present were Rick Young, Don Philbrick and Aaron Blake. The meeting was called to order at 7 p.m.

The Selectmen reviewed checks and signed the accounts payable manifest for $12,863.88 for 28 items.

The minutes for the meeting of September 9th were approved as amended.

Rick Young had met with Stewart Heath about the Blue subdivision road off Crystal Lake Rd. The work has been completed and is waiting on an inspection by the Board of Selectmen.

Rick Young said he had received a call from Betsy Edge about the stairs to her front deck, The stairs have been redone recently to bring them up to code but have been in existence since 1973.

Rick Young said there had been a call from FEMA about last years storm but neither the message nor the phone number were clear enough to be able to decipher properly.

Rick Young said there had been a call from Hoyle, Tanner and Associates on where to dispose of the granite abutments for the Potter Rd bridge.

To date the notice seeking bids for the cemeteries has not produced any response. A mailing to parties likely to be interested will be made.

Correspondence from Randy Cooper and Caroline Lucet concerning the issue over their driveway was reviewed and discussed. The Selectmen agreed to cost share in order to resolve the issue.

Rick Young took a phone call from David Arnold concerning his logging operation. David Arnold said he was not logging and was buying in wood that he was sawing up and selling for firewood. He said he did not have to answer the Selectmen’s questions. The Selectmen noted that this was a commercial operation in a residential zone. The Forest Ranger, Bob Boyd will be contacted to determine if any logging has taken place on the property.

Eleanor Valeriani filed a building permit application to enclose an existing deck for storage purposes. It was reviewed, approved and signed by the Board of Selectmen (Building permit #2821). The fee of $5 was paid by check.

No word has been received from the Campano’s regarding the land to be taken out of current use. The Selectmen agreed that it should all be taken out of current use and taxed accordingly.

A summary of changes to the Comprehensive Shoreland Protection Act was received from the Department of Environmental Services.

The specifications for resetting the granite slabs at the Eaton Cemetery were approved.

A check for $1,908.00 was received from the State for Revenue Sharing.

PSNH announced the schedule for their fall regional meetings.

TRICAP submitted data showing the extent of usage of their services by Eaton’s citizens.

Details of a New Hampshire Supreme Court decision on municipal liability were distributed.

BOARD OF SELECTMEN

September 23, 2008

The regular meeting of the Board of Selectmen took place on Tuesday, September 23rd, 2008 at the Evans Memorial Building. Present were Rick Young, Don Philbrick and Aaron Blake. The meeting was called to order at 7 p.m.

Ralph Meade picked up a building permit application.

Stewart Heath and Dick Fortin met with the Selectmen and discussed the Blue Rd off Crystal Lake Rd. It has been completed and inspected. A final bill will be forthcoming shortly.

Randy Cooper wished to speak with the Selectmen. Aaron Blake made a motion, seconded by Don Philbrick, to go into nonpublic session under RSA 91A;3e. On a roll call vote, the Board of Selectmen voted unanimously to go nonpublic session at 7:15 p.m.

The public session resumed at 7:30 p.m. The Selectmen voted unanimously to seal the minutes of the nonpublic session.

The minutes for the meeting of September 16th were approved as amended.

Issues over use of the Arnold property on Brownfield Rd were discussed and will be revisited next week. More information will be sought on it being a commercial venture.

Aaron Blake said he had provided information on the Eaton Cemetery project to a person in Conway. Four other people had made inquiries or been provided with a copy of the specifications.

Painting of the rear entrance to Town Hall was discussed.

The Selectmen agreed to send a letter to the Campano’s indicating their land will no longer be classified in current use because they have not provided the required map despite several requests to do so.

The Division of Parks & Recreation is proposing a self audit for land purchases made under the Federal Land and Water Conservation Grant Program. Applications for this year’s program were also solicited.

Details of the North Country Council program for Planning Officials on November 5th were distributed.

Changes to RSA 41:9-b relating to criminal background checks were discussed in an extensive communication from the New Hampshire Division of State Police.

Meg Gospodarek inquired about the address for an abutter whom she wishes to contact concerning a hazardous tree. She also entertained the Selectmen on other unrelated issues.

BOARD OF SELECTMEN

September 30, 2008

The regular meeting of the Board of Selectmen took place on Tuesday, September 30th, 2008 at the Evans Memorial Building. Present were Rick Young, Don Philbrick and Aaron Blake. The meeting was called to order at 7 p.m.

The Selectmen reviewed checks and signed the accounts payable manifest for $19,722.99 for 20 items.

The minutes for the meeting of September 23rd were accepted as distributed.

Rick Young noted that the one of the Mckenzie properties on Foss Mountain is on the market.

Randy Cooper wished to speak with the Selectmen. Aaron Blake made a motion, seconded by Don Philbrick, to go into nonpublic session under RSA 91A;3e. On a roll call vote, the Board of Selectmen voted unanimously to go nonpublic session at 7:20 p.m.

The public session resumed at 7:35 p.m. The Selectmen voted unanimously to seal the minutes of the nonpublic session.

At 7:40 p.m. Rick Young opened the bids for work in the Eaton Cemetery. The three bids were: Quint $10,400

J &S Masonry $ 2,150

The Selectmen set up a meeting with J & S Masonry next week to review the specifications and contract conditions.

Marnie Cobbs met with the Selectmen and discussed the McKenzie property on Foss Mt that is for sale. It was noted that the parcel was not accessible year round by public highway.

The Department of Environmental Services has issued a permit for operation of a septic system for the Long property on Hatch Hill Rd(Tax map R 11, lot 2A).

Signature item was a letter to the Department of Transportation requesting reimbursement for the State’s share of the Potter Rd Bridge costs incurred to date.

The Local Government Center has issued an update on "The Basic Law of Town, Village

and School District Budgeting" and a poster on the recent changes in RSA 91-A.
