TOWN OF EATON
PLANNING BOARD April 18, 2006
The Planning Board held their regular monthly meeting on Wednesday, April 18th, 2006 at the Evans Memorial Building. Present were; Paul Savchick, Dick Shaw, Sunni Wilkewitz, Nancy Malvesta and Joyce Blue. Alternate present was Lee Stack. The meeting was called to order at 7:05 p.m.
Lee Stack joined the Board.
The minutes for the meeting of March 15th were accepted as distributed.
Joyce Blue gave the Selectmen?s report. She said the Selectmen were still waiting to hear from Conway about setting up a meeting to discuss the recreation program. There is a proposal to put a cell tower on Manson Hill. The site is to be marked out and there will be another meeting at the end of April. There has been an inquiry about building on a back lot off Lary Rd that has been referred to the Town attorney.
Continuing with the Selectmen?s report, Joyce Blue said that Rick Young and Don Philbrick met with Councilor Ray Burton, representatives from the Department of Transportation and Ralph Meade from Camp Waukeela to discuss some issues affecting the camp. The visitors had also been exposed to Brownfield Rd. A follow up meeting is scheduled for June 28th. Don Philbrick has applied to the PUC to try and keep the pay phone at the Eaton Village Store. The revaluation is proceeding on schedule. The equalization ratio for the Town is now 50.2%.
Paul Savchick said the Conservation Commission had been working on updating the bylaws. They will be meeting with Cherryfield Foods on May 8th to discuss blueberry picking on Foss Mt.
There was a discussion about the Shoreland Protection Ordinance Committee. Paul Savchick said the committee was under the jurisdiction of the Planning Board. Rick Young said the work had been done by the Conservation Commission. Given what had happened to the ordinance the Selectmen had appointed a committee to redo it. Paul Savchick said there was only one person on the committee with any scientific expertise and no member from the Planning Board. Rick Young noted the Planning Board would review the final ordinance, that the committee was comprised of volunteers and there had not been any volunteers from the Planning Board.
Copies of the new Zoning Ordinance were distributed with a request that it be reviewed for the next meeting.
An article on a recent court decision on cell towers was distributed.
PUBLIC HEARING - TWO LOT SUBDIVISION - PETER BLUE ET AL
At 7:30 p.m. Paul Savchick opened the Public Hearing on an application from Peter Blue et al for a two lot subdivision for property located on Hatch Pond off Crystal Lake Rd (Tax map R-4, lot 2). A 16 acre lot is to be subdivided out of a 137 acre parcel.
Joyce Blue stood down from the Board.
In attendance were Dick Fortin, Holly Fortin, Shirley Blue, Paul Hennigan, Rick Young, Judy Goss, Fred Goss and Paul King, the surveyor for the proposal. Peter Blue made the presentation.
All notices required by statute had been posted, fees paid and abutters notified. No correspondence had been received.
The application was administratively complete. Sunni Wilkewitz made a motion, seconded by Dick Shaw, to accept the application. The motion carried unanimously.
Peter Blue explained that the proposal was the same as that turned down by the Planning Board at the last meeting. He distributed a list of waivers that were being requested. The complete list is in the file. Prompting discussion were two particular issues the waiver for a hammerhead and a waiver on the width of the road to 15'.
Paul Hennigan reiterated some of his concerns from the last meeting. He had reservatiosn about the long list of waivers being requested. There was some confusion over whether the road was to be built to Town specifications or was to be a paper road. Initially, Peter Blue indicated the applicants were not requesting a waiver from building the road but subsequent discussions put the paper road back on the table with a trigger to construct the road being built upon further development. There was an extensive discussion about the hammerhead, the dimensions of the turnaround in relation to the needs of fire equipment, and whether it was or was not permitted by the regulations. On the issue of road specs, Rick Young said that as a Selectmen had no problem with a hammerhead but did not support the road width being reduced to 15'. There was a suggestion that the plot plan should specify what the condition should be that would trigger the construction of the road.
The Public Hearing was closed at 8:30 p.m. The Planning Board continued to debate the issue. The Chairman composed a motion, subsequently proposed by Nancy Malvesta and seconded by Dick Shaw, that the application was approved subject to a stipulation that construction of a home would be conditional upon the road being built to Town specifications including a circular turnaround such conditional approval being subject to review by the Town attorney. The motion carried with Lee Stack opposed.
The hearing was continued to the next meeting on May 17th at 7:30 p.m.
