TOWN OF EATON PLANNING BOARD May 17, 2006 The Planning Board held their regular monthly meeting on Wednesday, April 17th, 2006 at the Evans Memorial Building. Present were; Paul Savchick, Dick Shaw, Sunni Wilkewitz, Nancy Malvesta and Joyce Blue. Alternates present were Lee Stack and Chris Kennedy. The meeting was called to order at 7:05 p.m. Lee Stack and Chris Kennedy joined the Board. The minutes for the meeting of April 18th were accepted as distributed. Joyce Blue gave the Selectmen?s report. She said the Selectmen met with the Conway Board of Selectmen to discuss the recreation program. The Selectmen have only heard from 3 people about the program. Conway agreed to meet with Albany and Eaton to discuss alternative mechanisms for funding but there would be no change for 2006. There has been a positive reaction from Madison in response to overtures about Eaton children joining their program. The Selectmen will be carrying out a survey to see if any children are interested in joining the Madison program. Joyce Blue said the US Cellular cell tower is on hold. Their initial choice of Manson Hill will not work at this time because a study indicated it could not link up with any existing towers. They are now looking at Libby Mountain. Dick Fortin made a presentation to the Board of Selectmen suggesting that a Planning Board member join the Shoreland Protection Ordinance Committee. There was some concern about reinventing the wheel. Joyce Blue said the floor in the basement of Town Hall has been sealed and finished. The Selectmen are seeking feedback on whether air conditioning should be installed. Joyce Blue said she and Nancy Malvesta had meet to review the status of the Master Plan. Paul Savchick, reporting for the Conservation Commission, said that six students from Eaton will be attending Tin Mountain summer camps this summer. There have been discussions with Cherryfield Foods about improving the blueberry fields and access roads to facilitate mechanical harvesting. It would consist primarily of removing the rocks. Paul Savchick said the Conservation Commission is advertizing for bids to bushwhack about 10 acres on the summit of Foss Mt. Lee Stack distributed recommendations of the definition of "emergency? as adopted in the zoning amendment adopted in March of preventing helicopter and aircraft landings and take offs except in "emergency situations". Emergency situations will consist of the fighting of fires, the evacuations of person in life or death situations. As approved by the Board of Selectmen, it could also include spraying for disease carrying insects and pests that impose a public health and safety hazard and or for agricultural needs. It was noted that while Zoning Ordinance amendments have to wait to within 120 days of Town Meeting before they can put events on hold a recommendation at this time may assist the Zoning Board of Adjustment should they have to deal with a request for a variance. Joyce Blue made a motion to accept the definition of emergency as presented. Seconded by Lee Stack. The motion carried unanimously. No changes to the body of the updated Zoning Ordinance were proposed. Lee Stack said the Table of Contents did not jibe with the page numbers and provided a revised list. Nancy Malvesta made a motion, seconded by Lee Stack to accept the updated Zoning Ordinance. The motion carried unanimously. The Planning Board will sign off on it at the next meeting. The telecommunications section of the Zoning Ordinance has been reviewed by Attorney?s Robert Ciandella and Katherine Miller. They indicated it need some minor revisions. They also proposed a different approach in which the Board elucidated a hierarchy of preferred sites with the application process being simpler for the preferred sites. It was noted that developing the hierarchy would involve considerable effort and require a radio frequency engineer to ensure the preferred sites are usable. The Planning Board elected to stay with modifications to the existing ordinance. The latest epistle of the Zoning Practitioner discussed build out analysis. PUBLIC HEARING - TWO LOT SUBDIVISION - PETER BLUE ET AL (Continued) At 7:30 p.m. Paul Savchick reopened the Public Hearing on an application from Peter Blue et al for a two lot subdivision for property located on Hatch Pond off Crystal Lake Rd (Tax map R-4, lot 2). A 16 acre lot is to be subdivided out of a 137 acre parcel. Joyce Blue stood down from the Board. Peter Blue represented the applicants. Communications between Paul Savchick and Attorney Laura Spector on the application resulting from the agreement arrived at last month were reviewed. Paul Savchick had asked about the legality of the conditional approval approved by the Board last month. Attorney Spector said the Zoning Ordinance required any new road to be built to Town specifications and since this was a zoning issue and not within the purview of the Planning Board. A bond also is also required as per subdivision regulations. After some discussion, Peter Blue indicated the applicants wished to proceed with whatever was required for approval. The list of waivers was discussed The Board voted unanimously to waive the requirement for HISS since both lots were in excess of 5 acres. Also waived unanimously was a perimeter survey of the large lot. Paul Savchick said a road profile will be needed along with a revised plan to show a circular turn around. The Public Hearing was closed at 8:20 p.m. Nancy Malvesta made a motion, seconded by Dick Shaw, to approve the application conditional upon 1. A revised plot plan showing a circular turnaround; 2. A road profile, construction details and a performance guarantee acceptable to the Board of Selectmen. The motion carried unanimously. Paul Savchick was authorized to sign the plans out of session. Joyce Blue discussed the Shoreland Protection Ordinance Committee. There was an extensive discussion about the previous attempts to generate an ordinance and the drafting of a new one. Paul Savchick was skeptical of the objective of generating a shorter simpler ordinance that would be of any value. There was a discussion about monitoring the progress of the Committee. Joyce Blue proposed joint meetings every couple of months with both the Conservation Commission and Shoreland Protection Ordinance Committee before a final version is presented to the Planning Board. The Shoreland Protection Ordinance Committee has been asked to make their minutes available to the Selectmen and the Planning Board. The meeting adjourned at 8:55 p.m. Respectfully submitted David V.
