PLANNING BOARD

October 18, 2006

The Planning Board held their regular monthly meeting on Wednesday, October 18th , 2006 at the Evans Memorial Building. Present were; Paul Savchick, Dick Shaw, David Sorensen Nancy Malvesta, Sunni Wilkewitz, Lee Stack and Joyce Blue. Visitor attending was Kenneth McKenzie. The meeting was called to order by Paul Savchick at 7:05 p.m.

The minutes for the meeting of August 16th were accepted as distributed.

Joyce Blue gave the Selectmen’s report. She said that the Town of Conway was soliciting bids for plowing the roads that Eaton has previously plowed. The Selectmen have received a petition to lay out Lary Rd and it has been referred to Town Counsel. A reconvened meeting with Councilor Ray Burton and State officials discussed further the beaver/flooding problem at Waukeela, erosion into Silver Lake on the Brownfield Rd as well as the condition of that road. A thin shim on small sections of it appears to be the limit of attention it will receive.

Paul Savchick said the Conservation Commission met with Arthur Harvey and others interested in the blueberries on Foss Mt. Kenneth McKenzie said he has been researching a coop that markets blueberries but there is nothing definitive at this time. Joyce Blue said that Arthur Harvey is not interested in the blueberries in Brooks Pasture because of an access issue. He may be interested in part of Foss.

PUBLIC HEARING - SITE PLAN REVIEW - CANDACE MAHER

At 7:15 p.m. Paul Savchick opened the Public Hearing on an application for a site plan review from Candace Maher to open up a retail store on property located on Stewart Rd (Tax map U2, lot 16).

All notices required by statute had been posted, fees paid and abutters notified. No correspondence had been received.

Joyce Blue made a motion, seconded by Dick Shaw, to accept the application. The motion carried unanimously

Candace Maher explained that she wanted to open a small shop at the front of her house in order to sell art works of her own making. She does not expect much traffic and the parking already exists. All parking will be on site and off the road.

It was pointed out that the plan did not indicate whether the property is within the Village District zone. The Village District zone extends 300' either side of the Brownfield Road. Paul Savchick estimated that the property was about 350' out and therefore lay in the Rural Residential Zone. He said any approval of the site plan would still be subject to the granting of a special exception by the Zoning Board of Adjustment.

It was noted there were some deficiencies in the application. One of abutters, the Fortins, had not been identified. Dick Fortin was present and said he had reviewed the plans and he had no objection to the hearing continuing.

Candace Maher said she would like to erect a small "Snowbrook Creations" lighted sign. It would not be distractive for traffic or neighbors.

A written waiver request for a drainage plan, an erosion and sediment control plan and abutter utilities was approved by unanimous consent since no new construction or changes to the existing property are involved.

On the plan it was noted the location of a well was incorrect.

After further discussion Nancy Malvesta made a motion to conditionally approve the site plan conditional upon the following:

1. The application to be corrected.

2. The plan to be revised to show the boundary of the Village District Zone.

3. The correct location of the well to be shown.

4. The illuminated sign should not be distractive to abutters or traffic.

5. Granting of a special exception by the Zoning Board of Adjustment under Article V 2d.

Joyce Blue seconded the motion. The motion carried unanimously.

OTHER BUSINESS

Kenneth McKenzie said he had read in the minutes of the Selectmen’s meetings that Don Philbrick had indicated that the realignment of Crystal Lake Rd was to go before the Planning Board shortly. Kenneth McKenzie wanted to be on record that, in his opinion, the realignment of the road could not take place without his permission since he has a deeded right of way along that road to his property Paul Savchick said the Board took note of his concerns. As yet the Board has not received any application for the realignment of Crystal Lake Rd.

The Board will defer discussion on the Shoreland Protection Ordinance until the next meeting along with other zoning issues.

The meeting adjourned at 8:55 p.m.
